Mr. Hartzell has extensive experience in a broad range of matters, representing both plaintiffs and defendants in complex civil litigation including commercial disputes, antitrust, eminent domain litigation, real estate, securities litigation and investigations, false claims act and state whistleblower, directors and officers, business torts, trade secrets, copyright, trademark, patent, civil RICO, insurance coverage, including environmental and bad faith claims, medical device litigation, class actions, contract actions, aviation, workplace and employment related matters, including discrimination claims, ERISA, construction, and environmental including Chapter 21E and CERCLA claims, banking litigation, creditors and debtors in bankruptcy proceedings, claims involving accountants, attorneys, design professionals as well as governmental investigations.  He has represented parties in zoning and permitting matters, and parties in loan workouts, including forbearance agreements, loan sales, related litigation and bankruptcy.

Mr. Hartzell served as lead counsel in major cases involving environmental contamination, bank fraud, professional liability, securities, directors and officers, toxic tort, antitrust, product liability, personal injury, class actions, and commercial disputes.  He has appeared before state and municipal boards and agencies and represented witnesses before federal and state grand juries.  He has tried more than 30 matters to verdict or arbitration award. As trial counsel, he has obtained multimillion-dollar verdicts, some of the largest in Massachusetts, in the area of environmental contamination. He has successfully mediated numerous disputes, including legal and accounting malpractice and professional liability claims.  He also has extensive experience representing various entities, including the Program Manager, in connection with the Central Artery/Tunnel Project, one of the most complex construction projects in U.S. history.

His recent experience includes:

  • Defense verdict on behalf of client in federal court six week jury trial in environmental case alleging PCB contamination
  • Summary judgment on behalf of plaintiff on note claim, awarded summary judgment on lender liability counterclaim, affirmed on appeal before First Circuit Court of Appeals
  • Summary judgment on behalf of multiple clients in $39 million alleged stock fraud claim
  • Defense verdict on behalf of client in multiple week jury trial on alleged stock fraud claim
  • Summary judgment on behalf of client employer in alleged discrimination claim
  • Dismissal of fraud complaint against former drug product manufacturer in alleged whistleblower claim
  • Obtained favorable settlement for software developer in intellectual property dispute
  • Summary judgment on behalf of insurer in coverage litigation
  • Representing individual in alleged securities fraud class action claim
  • Representing individual in alleged insider trading claim
  • Representing company in alleged anti-trust claim
  • Representing company on patent ownership issues

Mr. Hartzell also has an active appellate practice, having briefed and argued multiple cases before each of the First Circuit Court of Appeals, the Massachusetts Supreme Judicial Court and the Massachusetts Appeals Court.
