Alternative Dispute Resolution

Alternative dispute resolution (ADR) has become an important and well-accepted method of resolving disputes by means other than litigation, because it enables parties to achieve a more timely, cost-effective, efficient and confidential result. ADR generally involves any one of a number of procedures, including mediation, arbitration, mini-trial, and private judging, that utilize a neutral third party to make a decision or assist the parties in reaching a resolution.

At LeClairRyan, our team of highly experienced attorneys represents clients in all forms of ADR and acts as neutrals in arbitrations, mediations and other procedures to resolve disputes. Many of our attorneys have served as arbitrators through the American Arbitration Association, American Health Lawyers Association ADR Service, the National Arbitration Forum, the CPR Institute for Dispute Resolution, and FINRA in disputes involving business, securities, real estate, construction, healthcare, insurance coverage, employment, personal injury and regulatory matters, among others. We achieve favorable results for businesses of all sizes across the nation as well as in Europe.

Several of our attorneys are arbitrators and mediators certified by various U.S. District Courts and are listed on the roster of approved court-appointed mediators by the State of New Jersey Administrative Office of the Courts. Several of our California attorneys hold a Certificate in Dispute Resolution from the Straus Institute for Dispute Resolution at Pepperdine University in Malibu, California. Also, many of our attorneys have served as private arbitrators, mediators and special masters, having been chosen by their peers or appointed by the courts because of their experience, fairness and legal abilities, and, in the case of mediation, success rates in facilitating resolutions.

Knowledge and years of experience are required to understand the rules and strategies of dispute resolution. Our attorneys have the experience and knowledge necessary to help our clients consistently achieve favorable results through the ADR process.
