Environmental Law

In today’s complex society, the environment has become a major focus of concern. As a result, LeClairRyan's Environmental attorneys are at the forefront of litigation and regulatory matters pertaining to air and water pollution, waste disposal, as well as the manufacturing, shipping and storage of hazardous materials.

Our services include:

  • Defense of cost-recovery actions
  • Prosecution to recover cleanup costs from responsible parties
  • Transactional matters that implicate environmental concerns and regulations
  • Environmental due diligence in the sale or acquisition of businesses and business assets
  • Federal and state environmental reporting requirements
  • Environmental permitting
  • U.S. Environmental Protection Agency multimedia audits

Regulatory Compliance

Members of our team confidentially assist our clients in conducting environmental audits, or due diligence reviews, either in connection with ongoing operations or in anticipation of real estate transfers, corporate acquisitions or financing.

Collaborating with a network of experienced professionals, including hydrogeologists, forensic geochemists and licensed professional engineers, we are able to marshal the knowledge necessary to understand complex technical issues and, where the client's interests are best served in doing so, concisely and effectively present those issues to counter parties, regulators, judges, or juries.

In addition, our attorneys routinely handle a full spectrum of issues involving federal regulatory statutes, including the:

  • Comprehensive Environmental Response, Compensation and Liability Act
  • Solid Waste Disposal Act
  • Toxic Substances Control Act
  • Resource Conservation and Recovery Act
  • Emergency Planning and Community Right to Know Act
  • Clean Water Act
  • Clean Air Act
  • Safe Drinking Water Act

Our team also represents municipalities and waste disposal facilities in environmental disputes and permit hearings before various state and federal government agencies.

Toxic Tort Litigation

Members of our team are actively engaged in the defense of personal injury and property damage claims associated with toxic torts, including those related to asbestos, mold, chemical exposure, lead paint, and heavy metals. State and federal courts continue to maintain a large docket of toxic tort claims, leading to the consolidation of lawsuits into groups with multiple plaintiffs and defendants.

We have successfully defended equipment and product manufacturers, suppliers and premise owners through trial in this challenging matrix, and we hold a longstanding role as local and regional counsel for our toxic tort clients. In addition, our team members are experienced in all facets of defense strategy, including discovery, fact and expert witness preparation, pretrial motions, products investigation, corporate history, medical case evaluation, and trial.

Our attorneys are also well versed in the politics of toxic tort litigation and are familiar with plaintiffs’ counsel in many jurisdictions. We have coordinated the activities of joint defense groups and served on court advisory panels, roles that have enabled us to institute policies and procedures that in turn have advanced the strategies of our clients.

We also have extensive experience representing our toxic tort clients in state and federal district courts and regularly work with local and national counsel in jurisdictions nationwide. Through our multidisciplinary approach, our toxic tort attorneys have access to a broad internal knowledge base covering the products and corporate histories of many companies standing as defendants in jurisdictions across the nation.
