Intellectual Property: Chemical Arts

LeClairRyan offers a broad range of intellectual property services that are particularly focused on the chemical arts. We regularly assist clients with strategically managing their chemical patent portfolios and work with them to protect and maximize the value of their intellectual property rights. Our team of attorneys and Ph.D. patent agents and technical specialists offers a full range of intellectual property legal services in the chemistry field, including:

  • Drafting patent applications and prosecuting them through the U.S. Patent and Trademark Office to issuance
  • Rendering invalidity, non-infringement and freedom-to-operate opinions
  • Conducting intellectual property due diligence, particularly in the venture capital arena
  • Preparing and negotiating license agreements
  • Conducting inventorship analyses
  • Litigating chemical patents in national and international venues

We have substantial experience and knowledge in a variety of areas in the chemical arts, including:

  • Polymer chemistry (e.g., coatings, adhesives and film compositions)
  • Petrochemicals (e.g., rubbers and plastics)
  • Organometallic chemistry (e.g., coordination complexes, such as metathesis catalysts)
  • Agrochemicals (e.g., insecticides, herbicides and fungicides)
  • Combinatorial chemistry
  • Crystalline forms (e.g., polymorphs and co-crystals)
  • Nucleic acid and peptide chemistry (e.g., chemical modifications of oligonucleotides, polysaccharides and peptides)
  • Analytical and physical chemistry (e.g., spectroscopy, optics, microfluidics, and medical diagnosing and imaging devices)
  • Inorganic chemistry (e.g., transition metals, alloys and magnetic materials)
  • Electrical chemistry (e.g., batteries)
  • Photographic chemistry
  • Silicon chemistry
  • Specialty chemicals (e.g., chemical reagents/catalysts)
  • Chemical-based nanotechnology (e.g., sensors and display devices based on nanotubes, nanoparticles, organic films or semiconductor materials)

We have further significant experience in the related field of materials science, with extensive knowledge relating to glass, ceramics, fiber optics and thermal-management materials.

Our team members possess a particular depth of experience in post-issuance practice (interferences, reexaminations, reissues, and oppositions) and have handled numerous interferences before the U.S. Patent and Trademark Office on various chemical applications and patents. We routinely prosecute reexaminations as a strategic means to attack a competitor’s patent, either alone or in parallel with patent litigation. We have also utilized reissues to broaden or correct an issued patent as well as handle inventorship disputes. In addition, we work together with European counsel to manage European opposition proceedings, particularly in cases that involve corresponding U.S. patents.

Our chemical clients range from leading companies to mid-size chemical and pharmaceutical companies to start-ups. We also have experience working with technology transfer offices of large and small universities as well as the licensees that hold rights in the university-owned patents.
