LeClairRyan offers a broad range of intellectual property services that are particularly focused on the electrical, mechanical, optical, and computer hardware and software arts. We regularly assist our clients with the strategic procurement and management of their intellectual property assets domestically and internationally. Our practice comprises the preparation and prosecution of patents in areas including: computer software and hardware; internet and e-commerce; business methods; communications; semiconductor technologies; electrical, electro-mechanical, optical, solar, and other cleantech technologies; medical devices; and other mechanical disciplines. Additionally, our team of attorneys, patent agents and Ph.D. technical specialists offers a full range of intellectual property legal services, including intellectual property counseling, inventorship evaluations, opinions and strategy services, intellectual property audits and due diligence, drafting and negotiation of intellectual property licenses and technology agreements, and copyright registration and counseling.

Our team performs a broad scope of work in various electrical, mechanical, optical, and computer hardware/software technologies. For instance, in the electrical area, we have significant experience with computer hardware, semiconductor fabrication, analog and digital circuit designs, digital signal processing, memory technologies, radio-frequency identification (RFID) systems, antenna technologies, and electronic controls. In the mechanical area, we have a breadth of knowledge in technologies such as MEMS and microfluidic-related products, medical devices, cleantech systems, haptic systems, turbines, and compressors. In the optical area, we have substantial knowledge of a variety of technologies, including display screens, optical switches, solar-related products, and laser systems. In the hardware/software area, we have significant experience in a variety of fields, including computer hardware design, application-specific integrated circuits, network interface cards, network traffic systems, lad balancing, virtualization, e-commerce and internet-related systems, financial and insurance processes, web-based advertisements and online content, mobile communications processing and switching, and mobile applications.

In addition to our patent prosecution practice described above, we regularly advise and represent our clients in many post-issuance practices, in particular ex parte and inter partes reexaminations, intellectual due diligence reviews, preparation of non-infringement and invalidity opinions and intellectual property litigation support, interferences, reissues, and oppositions. This work has involved such proceedings individually, together and in conjunction with litigation. We are well versed in providing our clients with guidance on which proceeding to pursue based on cost, duration, objectives to be achieved, and the effect of various estoppels extant in inter partes reexaminations. We also counsel our clients on the merits of whether they should challenge a patent through reexamination or patent litigation.
