Biography

Jennifer L. Gray's practice focuses on representing financial institutions, corporations and other entities in lawsuits involving banking and financial services and products. Jennifer has significant experience in matters related to the Real Estate Settlement Procedures Act (RESPA), the Fair Housing Act (FHA), the Truth in Lending Act (TILA), the Fair Credit Reporting Act (FCRA), the Fair Debt Collection Practices Act (FDCPA), the Telephone Consumer Protection Act (TCPA), state and federal unfair and deceptive acts and practices laws (UDAP), other consumer lending statutes and regulations, bankruptcy laws and the common law. She frequently represents clients in cases involving loan origination and servicing practices, fair lending, residential foreclosure, bankruptcy and default issues, secondary markets, and consumer banking. She also counsels clients on compliance with state and federal laws affecting lending and servicing activities.

Prior to joining LeClairRyan, Jennifer held several senior in-house legal positions at financial institutions, including Head of Litigation at OneWest Bank N.A. (n/k/a CIT Bank, NA) and Assistant General Counsel, Litigation at JPMorgan Chase, where she managed consumer finance class actions.

Jennifer has also practiced at several large national law firms, where she represented financial institutions in a wide range of class action and complex civil litigation. In addition to consumer finance litigation, she has represented clients in a variety of commercial disputes, including antitrust litigation, contract actions, and insurance disputes.


Representative Experience

  • Representing CIT Bank in class action alleging improper placement of wind and hurricane property insurance. Wieck v. CIT Bank, NA, U.S District Court of Hawaii, Case No., 16-cv-596.
  • Representing mortgage loan servicers in putative class action involving IRS reporting of negative amortization principal payments. Rovai v. Select Portfolio Services, Inc., US District Court Southern District of California, Case No. 14-CV-1738-BAS-WVG.
  • Defending bank against claims that it aided and abetted a fund manager operate a Ponzi scheme. Grayson v. JPMorgan Chase Bank, NA, et al., Superior Court of California, County of Orange, Case No. 30-2017-00916027-CU-BT-CJC.
  • Obtained dismissal of aiding and abetting a fraudulent scheme and breach of fiduciary duty claims against JPMorgan Chase Bank, NA in connection with retail banking transactions. Hip Hop Beverage Corp. v. Juneice Michaux, et al., Case No. BC581642.
  • Obtained dismissal of RICO and other federal and state law claims against bank based on alleged failure to monitor correspondent banking activity. O'Hagins, Inc., v. HSBC Bank USA, N.A. U.S. District Court, Central District of California, Case No. 8:16-cv-00716-DOC-JEM.
  • Obtained dismissal of UCL claims asserting that JPMorgan Chase violated its insufficient funds policy. Musthaler v. JPMorgan Chase Bank, NA, Central District of California, Case, No. 8:17-cv-00794.
  •  Represented mortgage loan servicer in putative class action asserting that deed of trust reconveyance was not timely recorded under state law. Stromberg v. Ocwen Loan Servicing, LLC, Northern District of California, Case No. 15-cv-04719.
  • Represented mortgage loan servicers in putative class action involving IRS reporting of negative amortization principal payments. Camberis v. Ocwen Financial Corporation, U.S. District Court, Northern District of California, Case No. 3:14-cv-02970-MEJ.
  • Represented loan servicer in putative class action asserting claims under Nev. Rev. Stat. 107.080(7) involving non-judicial foreclosure process. Torno v. Green Tree Servicing, LLC, District Court Clark County, U.S. District Court of Nevada, Case No. 2:15-cv-01018- APG-PAL.
  • Represented mortgage servicer in putative class action involving timing for posting of borrower’s mortgage payments. Argyropoulos v. Ocwen Loan Servicing, LLC, Central District of California, Case No. 2:15-cv-04654-SVW-FFM.
  • Obtained favorable result in putative class action asserting FCRA and California Consumer Credit Reporting Claims involving credit reporting of second liens. Denham v. Ocwen Loan Servicing, LLC, U.S. District Court, Central District of California, Case No. 2:15-cv- 05273-DMG (Plax).
  • Obtained favorable resolution in putative class action asserting that defendant violated FCRA by reporting mortgage loan deficiency balance. Kuns v. Ocwen Loan Servicing, LLC, U.S. District Court, Central District of California, No.12-CV-7118 (DMG) (PLAx).
  • Obtained dismissal of putative class claims asserting that default status notices violated FDCPA. Weiss v. Ocwen Loan Servicing, LLC, U.S. District Court, Eastern District of New York, Case No. 2:1 5-cv - 1050.
  • Obtained dismissal of putative class action asserting FCRA claims for alleged failure to properly report short sale transactions. Young v. OneWest Bank N.A., U.S. District Court Southern District of California, Case No. 3: 13-cv-01473-BAS-KSC.
  • Represented OneWest Bank in several putative class actions asserting violations of California Penal Code §§ 632 & 632.7 (call recording privacy laws).
  • Represented NASDAQ broker-dealer in antitrust class actions alleging price fixing and manipulation conspiracy on the NASDAQ market, together with representations in related SEC, DOJ, and state Attorneys' General investigations. In re NASDAQ Market-Makers Antitrust Litigation, United States District Court, S.D. New York, Case No. No. 94 Civ. 3996 (RWS).
  • Obtained dismissal of Sherman Act claims against consulting company defendant in suit involving alleged conduct by major life insurance companies. Intellective, Inc. v. Massachusetts Mut. Life Ins. Co., 190 F.Supp.2d 600 (S.D.N.Y. 2002).
