Biography

Megan Ben’Ary maintains a national practice defending lawsuits filed against clients within the consumer credit, mortgage, debt collection, employment background screening and student lending industries. She has developed a particular expertise in litigating individual and class action matters involving federal consumer protection statutes, including the Fair Credit Reporting Act, the Fair Debt Collection Practices Act, the Truth in Lending Act and the Real Estate Settlement Procedures Act, as well as related state laws.

Megan has been recognized as a Washington, D.C. Super Lawyer since 2015, a Virginia Super Lawyer since 2014 and a Virginia Super Lawyers Rising Star since 2009.

  • Represented a consumer reporting agency in a class action lawsuit alleging violations of the Fair Credit Reporting Act based upon the failure to provide proper notice to consumers when reporting public record information for employment purposes, the failure to comply with adverse action notice requirements, and the failure to conduct timely reinvestigations upon receipt of consumer disputes.
  • Represented a consumer reporting agency in a class action lawsuit alleging violations of the Fair Credit Reporting Act based upon the reporting of outdated public record information in consumer background reports.
  • Represented an employer in a class action lawsuit alleging violations of the Fair Credit Reporting Act based upon the failure to obtain proper authorization before requesting background reports on applicants and for violation of adverse action requirements.
  • Represented a consumer reporting agency in a class action lawsuit alleging violations of the Fair Credit Reporting Act based upon the failure to provide proper notice to consumers when reporting public record information for employment purposes.
  • Represented a consumer reporting agency in an indemnity action by a debt collector sued for class action violations of the Fair Credit Reporting Act.
  • Served as national counsel to consumer reporting agency in individual lawsuits filed in courts across the country alleging violations of the Fair Credit Reporting Act.
  • Represented a law firm engaged in the collection of defaulted mortgage loans in a class action lawsuit alleging violations of the Fair Debt Collection Practices Act and state consumer protection statutes.
  • Represented a collection agency in a class action lawsuit alleging violations of the Fair Debt Collection Practices Act based upon collection activities on behalf of homeowners’ associations.
  • Represented a collection agency in a class action lawsuit alleging violations of the Fair Debt Collection Practices Act based upon the collection of defaulted student loans subject to a federal loan rehabilitation program.
  • Represented a settlement services company in a class action lawsuit alleging violations of the Real Estate Settlement Procedures Act and state consumer protection statutes.
  • Represented a residential property manager in a class action lawsuit alleging violations of the Equal Credit Opportunity Act related to compliance with adverse action requirements.
