Michael Grant is a partner and member of the Firm’s Banking and Consumer Financial Services Litigation Practice Area Team. Mike represents banks, servicers, auto finance companies, commercial lenders, and other financial institutions in consumer financial services and banking litigation. His experience ranges from the defense of simple individual claims to complex class action suits, often involving claims of false or deceptive practices, statutory consumer lending violations, usury and other common law contract and tort claims. Mike also represents lenders in complex commercial loan workouts, foreclosures, negotiable instrument litigation and in all facets of bankruptcy matters including motions for relief from stay, proof of claim filings, and adversary proceedings.

In addition, Mike defends companies in wage and hour class actions and counsels employers concerning a variety of employment issues, including discrimination, harassment, non-compete and other contractual matters.

Mike has obtained successful outcomes for clients at every stage of the trial process, including case-ending motions to dismiss, summary judgments, trials and appeals in both state and federal courts. Mike's goal in litigation is to work with clients to determine a strategic end-game and then effectively execute to achieve an expedient, cost-effective result.

Representative Experience

  • Advised auto finance company concerning competing security interests between retail lender and floorplan lender in dealer workout
  • Successfully represented auto finance company in enforcing creditor’s rights in dealer bankruptcy proceedings
  • Successfully defended auto finance company against claims for violations of the Equal Credit Opportunity Act, Truth in Lending Act, Fair Debt Collection Practices Act
  • Successfully defended auto finance company against claims for wrongful repossession, unfair and deceptive trade practices and UCC violations
  • Successfully represented financial institution at trial in foreclosure action involving counterclaims concerning servicing of reverse mortgage loan
  • Successfully represented loan servicer at trial in wrongful foreclosure action involving statutory and common law lender liability claims
  • Represented financial institution against multibillion-dollar claims brought by an institutional investor in connection with the sale of residential mortgage-backed securities by means of allegedly untrue statements
  • Obtained dismissal of two class actions brought against a financial institution in the wake of the Bernard Madoff scandal
