Biography

Mr. Callahan has over twenty-four years of experience in representing businesses, financial institutions, investment firms who have purchased troubled debt, business owners and other entities in bankruptcy and insolvency matters. He is skilled in litigation in the bankruptcy context, in assisting clients in identifying and implementing effective resolutions to the problems facing his clients, and in formulating effective strategies for avoiding future problems.

The majority of Mr. Callahan’s practice has been in the United States Bankruptcy Court for the Western District of Virginia. He has also appeared in matters before the United States Bankruptcy Courts for the Eastern District of Virginia, the Western District of North Carolina and the District of Delaware. He has represented every constituent in bankruptcy matters, Chapter 11 debtors, creditors both secured and unsecured, official committees of creditors, trustees, financial institutions, and business debtors in both liquidation and reorganization cases. Mr. Callahan has served as a Chapter 11 Trustee in a large construction company case and continues to serve as the Trustee of a creditor’s trust formed by the confirmed plan in a Chapter 11 case.

Mr. Callahan also represents financial institutions outside of bankruptcy proceedings in a wide variety of matters, including foreclosures, collection proceedings, and the development of non-judicial liquidation strategies.

Mr. Callahan has served on the Panel of Chapter 7 Trustees in the Western District of Virginia since 1999. During this time, Mr. Callahan has liquidated a wide range of businesses and property, including a grocery store chain, two heavy equipment contractors, a plywood manufacturing plant, numerous coal mining operators, a textile manufacturer, a metal machining facility and vast amounts of real estate, both residential and commercial, in an amount totalling well in excess of ten million dollars. Through this experience, he has developed unique skills, knowledge, resources and methods that he can apply to the liquidation of all types of assets both inside and outside of a bankruptcy proceeding.

Mr. Callahan has significant experience in litigation proceedings in Bankruptcy Court. During the course of his career, he has prosecuted and defended against hundreds of litigation proceedings brought in bankruptcy cases. These proceedings include representing the LandAmerica Financial Group Liquidating Trustee in approximately 400 actions in the United States Bankruptcy Court for the Eastern District of Virginia seeking the recovery of preferential transfers made to creditors and representing a creditor seeking the exception of its debt from a Chapter 7 debtor’s discharge under section 523 of the Bankruptcy Code in the Western District of North Carolina.

Mr. Callahan has been recognized as one of the Best Lawyers in America since 2010 and has been recognized as a Virginia Super Lawyer since 2012. He has served as an Adjunct Professor at Washington and Lee University School of Law and is a regular lecturer at continuing legal education seminars. He is a co-author of the chapter of Ethics Violations, Fraud, and Crime in the current edition of Bankruptcy Practice in Virginia.

He is a graduate of the University of Virginia (B.A., with Honors 1975) and Washington and Lee University School of Law (J.D., magna cum laude, 1994), where he served as a Staff Writer for the Washington and Lee Law Review and was awarded the Order of the Coif, which is given to the top ten students in the graduating class.
